1. Acceptance of Terms
When booking a guided experience with Yläperän Safarit Oy / Kilpisjärvi Reindeer, hereafter referred to as the Merchant, the Customer agrees to adhere to these terms and conditions. By booking guided experiences, the Customer also agrees to observe the instructions and security guidelines provided by activity guides on location.
2. Bookings and Cancellations
2.1 General Terms
All prices include Value Added Tax.
The Merchant sells products and services to private individuals aged 18 years and older, as well as to registered companies.
These terms apply to bookings made online and through other means, such as phone, email, or in-person appointments.
The Merchant’s right to change prices, terms, and conditions without prior notice is reserved. The prices, terms, and conditions are those that are in effect at the time of payment by the customer and apply to the booking.
2.2 Bookings
These terms apply to all products and services.
It is the Customer’s responsibility to review the service description, guidelines, and terms and conditions before booking.
The Customer makes payments online following the payment transaction provider's (VismaPay) terms.
The reservation system automatically sends a booking/payment confirmation to the email address provided by the Customer during the booking process.
The Merchant is not responsible for booking process failures, such as technical issues with the booking platform. If issues occur, the Customer is requested to contact the Merchant to resolve the problem. The availability of the service cannot be guaranteed in such instances. If the service is unavailable, the Customer will receive a refund for a paid service or can choose an alternative service or time period based on current availability.
2.3 Cancellation by the Customer
A cancellation is effective on the date the Merchant receives a written cancellation notification.
If the cancellation is made at least 31 days before the scheduled service date, the Customer incurs an administrative service fee equal to 10% of the reservation's value or €25, whichever is greater. If the cancellation is made between 30 and 8 days before the service date, the Customer incurs a fee equal to 30% of the reservation's value. No refunds are provided for cancellations made within 7 days of the service date.
When booking and paying for the service with a discount code, a 100% cancellation fee applies, regardless of the cancellation date.
2.4 The Merchant’s Right to Cancel a Booking
The Merchant may cancel a booked service due to adverse weather conditions or other circumstances that make the service unsafe. In such cases, the Customer receives a full refund.
The Merchant may change the planned duration and timing of the service when deemed necessary for safety or customer comfort.
The Merchant reserves the right to cancel or terminate a service if a participant, as determined by the guide in charge, is in poor health or may pose a danger to themselves or others. In such cases, the Customer is not entitled to a refund, and unused services are not reimbursed.
3. Terms of Delivery and Payment
The contract between the Merchant and Customer is binding once the Customer has paid and the payment information has been received by the Merchant.
The payment transaction provider chosen by the Merchant is VismaPay. The Merchant does not collect the Customer’s bank or credit card information during the booking process. If the payment transaction is not completed correctly at the time of booking, the Merchant will not process the reservation.
The Customer is expected to adhere to the payment guidelines of VismaPay.
3.1. Payment by Invoice (Available to Registered Companies Only and Subject to Special Agreement)
Invoices must be paid by the due date. Payments received after the due date are subject to a reminder fee as well as overdue interest, which will be added to the invoice. If the invoice is paid after the due date and overdue interest has accrued, the overdue interest will be billed separately.
4. Injuries and Responsibility of the Merchant
All reindeer used in the services are trained to the best of the Merchant’s ability. However, animal behavior is unpredictable, and to minimize risks, the Customer must follow safety and conduct instructions provided by guides on location.
Lapland can have harsh weather conditions, with winter temperatures ranging from 0°C to -35°C (32°F to -31°F). Reindeer services are not canceled due to the cold weather. Customers are responsible for dressing appropriately for cold and windy conditions.
While the Merchant exercises caution and implements safety measures in organizing these services, the Customer participates at their own risk. Children aged 4 and older and individuals under the age of 18 may participate if accompanied and supervised by their parents or legal guardians at all times.
The Merchant carries General Third Party Liability Insurance for bodily injury and property damage according to the terms and conditions of Pohjola Insurance. The Customer is urged to carry a personal Travel Accident Insurance.
The Merchant may only be held liable for personal injury or material damage arising from accidents that have happened during the delivery of the offered services and which were caused by the provision of faulty equipment.
5. Photography and Media
The Merchant may take photographs or videos during activities for promotional purposes. By participating, the Customer grants the Merchant the right to use such media without compensation.
6. Privacy
The Merchant respects the Customer’s privacy and will handle their personal information in accordance with the Privacy Policy, which can be found on the Merchant’s website.
7. Reclamations
Reclamations must be reported to the Merchant immediately on location. If the matter cannot be resolved or a refund is requested, the reclamation must be submitted to the Merchant in writing within 30 days. Every effort will be made to handle the reclamation without delay, but no later than 30 days from its receipt.
If a satisfactory resolution is not reached, the Customer can submit the reclamation to the Consumer Disputes Board. Any dispute that requires legal action will be settled solely in the District Court of Lapland.
